Terms & Conditions Botzbrain – Fiona AI

Welcome to Fiona AI, a product proudly developed and operated by Botzbrain Inc. (“we”, “our”, “us”), based in Montreal, Quebec, Canada. These Terms and Conditions (“Terms”) govern your access to and use of the Fiona AI platform, website, mobile applications, and related products and services (collectively, the “Service”).

By accessing or using Fiona AI, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the Service. These Terms form a binding legal agreement between you and Botzbrain.

1. Definitions

“Fiona AI” means our proprietary AI-powered recruitment and analytics platform.

“Botzbrain” refers to Botzbrain Inc., the legal entity operating Fiona AI.

“User” or “Customer” means any person or organization who accesses or uses Fiona AI.

“Candidate Data” means personal or professional information provided by candidates or processed on their behalf.

“Subscription” refers to a paid plan granting access to certain premium features or services.

2. Permitted Use

Fiona AI is designed to streamline and optimize recruitment operations. You may use the Service only for lawful, authorized, and ethical hiring-related purposes, including but not limited to:

• Posting, managing, and tracking job opportunities.
• Screening candidates using AI tools to assess skills and competencies.
• Collaborating within your hiring team or organization.
• Accessing analytics and performance reports to improve recruitment outcomes.

You are solely responsible for ensuring that your use of Fiona AI complies with applicable employment and privacy laws in your jurisdiction.

3. Account Registration & Responsibilities

To access certain features, you must create a Fiona AI account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the confidentiality of your login credentials.
• Be responsible for all activity under your account.
• Notify Botzbrain immediately of unauthorized use or security breaches.

Botzbrain reserves the right to suspend or terminate accounts that violate these Terms or compromise the platform’s integrity.

4. Restrictions

Users agree not to:

• Use Fiona AI to collect or process sensitive data unrelated to recruitment.
• Exploit the Service for discrimination based on race, gender, origin, or appearance.
• Share, resell, or lease platform access to third parties.
• Interfere with or disrupt platform operations, servers, or networks.
• Use bots, scrapers, or other automated tools to extract platform data.
• Reverse engineer or attempt to copy Fiona AI’s source code or proprietary algorithms.

5. Data Protection & Privacy

We take your privacy seriously. Fiona AI complies with PIPEDA (Canada) and GDPR (Europe) standards. By using the platform, you acknowledge our right to process data in accordance with our Privacy Policy.

• User and candidate data are encrypted at rest and in transit.
• Botzbrain does not sell or share personal data with unauthorized third parties.
• You retain full ownership of your uploaded data and may request deletion at any time.
• We may use anonymized, aggregated data to improve system performance and AI accuracy.

Each organization using Fiona AI is responsible for obtaining consent from candidates whose data they process on the platform.

6. Intellectual Property

All intellectual property rights in Fiona AI, including its design, source code, algorithms, branding, and documentation, remain the exclusive property of Botzbrain Inc. or its licensors.

• Nothing in these Terms grants you ownership of any part of Fiona AI.
• You may not copy, modify, or create derivative works from our software.
• All trademarks, logos, and service marks displayed on the platform are the property of Botzbrain.

7. Billing & Subscriptions

Fiona AI operates on a subscription model. By subscribing, you agree to pay the fees specified at the time of purchase. All payments are due in the currency indicated on our website.

• Subscription fees are non-refundable except as required by law.
• Failure to pay may result in suspension or termination of your access.
• Botzbrain may adjust pricing upon renewal with reasonable prior notice.
• Taxes, if applicable, will be added based on your billing location.

You may cancel your subscription at any time; however, cancellation will be effective at the end of the current billing period.

8. Limitation of Liability

To the fullest extent permitted by law, Botzbrain shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use or inability to use the Service.

We do not warrant that Fiona AI will be error-free, uninterrupted, or entirely secure, though we take all reasonable measures to maintain system reliability and performance.

9. Termination

We may suspend or terminate your account immediately, without prior notice, if you breach these Terms or engage in activity that harms other users or the platform’s integrity.

Upon termination, you will lose access to all Services, and your stored data may be deleted after a retention period unless required otherwise by law.

10. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada. Any dispute arising from these Terms shall be resolved through binding arbitration in Montreal, Quebec.

You agree to first attempt to resolve disputes informally by contacting legal@botzbrain.com.

11. Updates & Modifications

Botzbrain reserves the right to modify or update these Terms at any time. Updates will be posted with a revised “Last Updated” date. Continued use of Fiona AI after changes become effective constitutes your acceptance of the revised Terms.

We also reserve the right to modify, suspend, or discontinue parts of the Service for maintenance, upgrades, or legal compliance.
